Can a General Engineering Consultant or Annual Service Contract be used to develop a LAP project?

Answer: Only, if the specific LAP project is listed on the Request for Proposal.

Can a consultant or contractor become LAP certified?

Answer: No. LAP certification is only available to Local Agencies.

What is the definition of a Local Agency?

Answer: A Local Agency is defined as a unit of government with less than statewide jurisdiction or any officially designated public agency or authority of such a unit of government that has the responsibility for planning, construction, operation or maintenance of, or jurisdiction over, a transportation facility. The term includes, but is not limited to, a county, an incorporated municipality, a Metropolitan Planning Organization (MPO), an expressway or transportation authority, a road and bridge district, a special road and bridge district or a regional governmental unit.

Is contract compliance an eligible reimbursement expense?

Answer: Yes, contract compliance can be covered under phase 68 Construction Engineering Inspection of the LAP Agreement.

Can a Local Agency hire a construction management firm to monitor contract compliance?

Answer: Yes. The contract should be programmed as a phase 68 Construction Engineering Inspection.

Where can I learn more about the requirements for procurement of consultant services for federal-aid projects?

Answer: Procurement of consultant services with federal-aid must conform to the requirements of the regulations in 23 Code of Federal Regulations 172. The regulations require a qualification based competitive negotiation selection process per the federal Brooks Act. The Florida Department of Transportation procedure 375-030-002, Acquisition of Professional Services is approved for use on federal-aid projects. This procedure is consistent with the Florida Consultant Competitive Negotiation Act.
